Conveyancing attorneys

Only an admitted conveyancer — an attorney who has passed the conveyancing examination and holds a Legal Practice Council fidelity fund certificate — may pass transfer in a Deeds Registry. Elysian verifies both before a firm appears here.

Transferring attorney
Nominated by the seller, holds the deposit in trust, attends to transfer duty, rates and levy clearance, and lodges the deed.
Bond attorney
Appointed by the buyer's bank to register the new bond. Registers simultaneously with the transfer.
Cancellation attorney
Appointed by the seller's bank to cancel the existing bond on registration.

Transfer sequence

  1. 01Instruction and FICA on both parties (Financial Intelligence Centre Act 38 of 2001).
  2. 02Transfer duty declarations and SARS transfer duty receipt or exemption.
  3. 03Rates clearance certificate from the municipality; levy clearance from the body corporate or HOA.
  4. 04Bond cancellation figures requested; guarantees issued by the bond attorney.
  5. 05Documents signed by buyer and seller; costs paid.
  6. 06Lodgement at the Deeds Registry — typically 7 to 10 working days on the deeds roll.
  7. 07Registration, payment of proceeds, and key handover.
